기르케(O. Gierke): 공동체로서의 지방자치단체와 국가

Abstract

기르케는 자발적으로 형성된 공동체를 게르만 민족의 역사발전 기본단위로 보고 단체이론을 정립하였다. 그는 로마 전통의 실정법보다 게르만 관습법을 중시하고 법인실체설을 주장한 법학자로, 게르만 공동체를 역사적으로 분석한 역사학자 겸 사회학자이자, 이들 단체 간의 권력 현상을 분석한 정치철학자로, 또한, 국가도 하나의 단체라는 사실을 역사적으로 규명한 다원주의자의 시조로, 지방자치권이 고유권이라는 근거를 제공한 지방자치학자로 알려져 있다. 그는 국가를 단체들의 결합으로 만들어진 존재로 간주했기 때문에 ‘단체의 연합으로 만들어진’ 다원적인 구조를 이상적인 통치 형태로 보았다. 그러나 아쉽게도 그의 공동체 이론은 당시 국가지상주의 논리에 밀려나 큰 빛을 보지 못하였다. 이 논문은 기르케의 사상을 재조명함으로써 우리의 지방자치이론의 지평을 넓힘과 동시에 우리 국민들에게 지방자치 의식을 고취하는 데 도움을 주고자 한다.

Otto von Gierke regarded the self-associations as the basic unit of historical progress of German Nation and developed the theory of Genossenschaft(fellowship). He was known as a Germanisten legal scholar who asserted the appropriation of German law rather than Roman Law and developed the legal real personality theory against the fiction theory of Romanisten; a historian as well as sociologist who analyzed various German social groups; a political philosopher who analyzed power struggles between associations and cental government; the first pluralist who insisted the state as one kind of association; and a scholar of local autonomy who set the basis for the indigenous right of local autonomy theory. Gierke regarded the state as a association of associations and idealized the federative structure of the state. However, his theory of social construct was set aside by the statist and then ignored until recently. This paper reviews to his theory of fellowship and intends to give some lessons in developing pluralist idea and promotes the awareness of local autonomy in Korea.
